01

Who We Are

INKOME LLC is the controller of personal information we process for our own purposes, including operating inkome, managing accounts & subscriptions, providing support, measuring use of the Service & protecting the Service.

This Policy also covers hosting, publishing & related features supplied through an inkome account, including those using Publy Store branding. Separate services & creator stores may have their own privacy policies.

Where we process buyer information solely on a creator’s behalf & under their instructions, the creator is the controller & we act as a processor for that processing. The creator’s privacy policy explains their use of that information. Our role depends on the purpose of each processing activity; handling information as a processor for a creator does not change our controller role for our own account, billing & service-management activities.

02

Information We Collect

Depending on how you use the Service, we collect the categories of information described below. Examples within these categories include, but are not limited to:

  • Account information. Your email address, account identifier, basic profile information, account settings & subscription details. When you sign in through Google or Discord, we receive information shared by that provider.
  • Content & channel information. Content, prompts, files, branding & instructions you provide or select; generated products, images, store pages & promotional materials; & public channel or video information used by available features, including public comments, captions or transcripts. This information may contain personal information about you or others.
  • Connected service information. Store identifiers, connection credentials, product details, order events, sales information & buyer email addresses received from the commerce services you connect.
  • Billing information. Payment status, billing references, invoices & transaction records. Payment providers process your payment details. We do not store full payment-card numbers.
  • Usage & device information. IP addresses, browser & device information, timestamps, pages visited, referral information, interactions, link clicks & diagnostic records.
  • Communications. Information you provide when contacting us, requesting support, submitting feedback or exercising your privacy rights.

We receive information directly from you, automatically through use of the Service, & from sources such as sign-in providers, public platforms & connected services. Information required to provide a requested feature must be supplied for that feature to work.

03

How We Use Information

We use information to:

  • Provide, maintain & improve the Service.
  • Create & manage accounts, subscriptions & payments.
  • Analyze selected content & generate products, stores & promotional materials.
  • Operate hosting, publishing, commerce integrations & performance tracking.
  • Respond to requests & communicate about the Service.
  • Detect abuse, protect accounts, enforce our Terms & meet legal obligations.
  • Mention permitted channel names as users of inkome in our marketing, as described in our Terms of Service.

Buyer information processed on a creator’s behalf is used to support that creator’s store & instructions.

05

How We Share Information

We share information in the following circumstances:

  • Service providers. With providers supporting hosting, storage, authentication, AI processing, payments, diagnostics, product analytics & session replay, security & other service operations. AI providers process relevant source content, instructions & generated material to create or review outputs, under the applicable service arrangements.
  • Connected services. With platforms you connect or choose to publish to, as needed to perform your instructions & operate the integration.
  • Creators & authorized users. With the creator whose store or account the information concerns, including authorized agency or business users.
  • Public content & marketing. Generated stores & product pages are password protected while marked Draft & become publicly accessible when you publish them. People you share a draft password with may view the draft. For marketing, we may mention permitted channel names as users of inkome under the permission in our Terms of Service. That permission covers channel names only, not logos, products, promotional materials, store pages or other content. Pro requires permission for a channel-name reference unless it is already permitted under a Creator subscription. References must accurately describe current or past use & remain subject to applicable privacy rights.
  • Legal & business purposes. Where reasonably necessary to comply with law, protect rights or safety, address fraud, establish or defend claims, or complete a merger, acquisition, financing or other business transfer. We may share relevant information with professional advisors & transaction parties, subject to appropriate confidentiality protections.
  • With your direction or consent. Where you instruct us to share information or provide permission for a separate purpose.

During the 12 months before the date above, inkome has not sold personal information or shared it for cross-context behavioral advertising. If these practices change, we will provide updated disclosures & any required consent or opt-out options before the change begins.

06

Third-Party Services & YouTube

The Service uses third-party services, including, but not limited to, Google, Discord, YouTube, payment processors & commerce platforms. Their own privacy policies govern information they process independently.

inkome uses YouTube API Services to obtain public YouTube information for channel analysis & related product features. Google’s practices are described in the Google Privacy Policy. Use of YouTube-related features is also subject to the YouTube Terms of Service.

Google sign-in provides basic account information & does not itself grant access to private YouTube videos, analytics or revenue information. You can manage Google sign-in permissions through your Google account settings.

Revoking sign-in access does not delete information already stored by inkome. To request deletion of your account information or stored YouTube data relating to you, contact data@inkome.ai.

07

Cookies & Similar Technologies

We use cookies & similar technologies for functions such as sign-in, security & measuring interactions with hosted pages or tracking links.

You can manage or delete cookies through your browser. Blocking certain cookies may affect account features. Where applicable law requires consent for cookies or similar technologies, we obtain it before their use.

Third-party services may use their own cookies when you visit their sites or checkouts.

08

Data Retention

We retain personal information for as long as reasonably necessary to provide the Service, fulfill the purposes described in this Policy & meet legal, accounting, security or dispute-resolution requirements.

Unless you renew or request earlier deletion, project data is deleted from active account storage 90 days after paid access ends. Download or export products you need before access ends. Source data may be subject to shorter retention or refresh requirements imposed by the relevant provider.

Buyer information processed on a creator’s behalf is returned or deleted at that creator’s choice under Selling Products & Your Buyers in our Terms of Service, subject to legally required retention consistent with applicable data-protection requirements. These rules take priority over the general retention periods above where data-protection law requires it.

Certain records may be retained for legal or accounting purposes. Subject to the buyer-information rules above & any applicable deletion deadline, deleted information may remain in backups until those copies expire or are overwritten. If a backup is restored, applicable deletion requests must be reapplied.

Marketing records containing permitted channel-name references may be retained under the permissions granted in our Terms, subject to accuracy & applicable personal data rights. Deleting information from inkome does not automatically delete copies held independently by creators, buyers or third-party services.

09

International Transfers

Information may be stored, processed or accessed in the United States & other countries where our personnel or service providers operate. Those countries may have different data protection laws.

Where a transfer is covered by an applicable adequacy decision or regulation, it may proceed on that basis. Otherwise, where contractual safeguards are required for a transfer subject to EEA data protection law, the relevant mechanism is the European Commission’s Standard Contractual Clauses. For transfers subject to UK data protection law, the relevant contractual mechanism is the UK International Data Transfer Agreement or the UK Addendum to those clauses. Any additional safeguards required for the transfer must also be in place.

The mechanism depends on the destination, recipient & law applicable to the transfer. Contact data@inkome.ai to ask which mechanism applies to your information & to obtain a copy of the relevant safeguards. We may redact information necessary to protect confidential commercial terms or the rights of others.

10

Your Choices & Rights

Depending on your location & applicable law, you may have rights to:

  • Access, correct or delete your personal information.
  • Receive a portable copy of certain information.
  • Restrict or object to certain processing.
  • Withdraw consent where processing relies on consent.
  • Opt out of a sale of personal information, sharing for targeted advertising or certain profiling, where applicable.
  • Appeal a decision concerning a privacy request.

Send requests to data@inkome.ai. We may request information reasonably necessary to verify your identity or an authorized agent’s authority. We respond within the period required by applicable law & will not unlawfully discriminate against you for exercising your rights.

Where we rely on legitimate interests, you may object based on your circumstances. You may object to the use of your personal information for direct marketing at any time.

You can disconnect supported commerce integrations through your account. Account deletion & personal information exports are available by email request. When we receive a verified account-deletion request, we stop future subscription renewals as part of processing that request. If your request concerns information processed on a creator’s behalf, contact that creator; we will assist as required.

You may also complain to the data protection authority responsible for your jurisdiction. In the UK, this is the Information Commissioner’s Office.

11

Security

We use reasonable technical & organizational measures designed to protect personal information against unauthorized access, loss, misuse or disclosure. Access is limited according to service needs & personnel responsibilities.

No method of online transmission or storage is completely secure. We cannot guarantee absolute security.

12

Children's Privacy

The Service is intended for users who meet the age requirements in our Terms of Service & is not directed to children.

If we learn that someone below the permitted account age has provided personal information through an inkome account, we will take appropriate steps to close the account & delete associated information, unless retention is legally required. Contact data@inkome.ai if you believe this has occurred.

13

Changes & Contact

We may update this Policy as the Service, our practices or applicable requirements change. We will update the date above & provide notice of material changes through the Service or by email. Where a change requires consent or additional privacy choices, we will provide them before the relevant processing begins.

For privacy questions or requests, email data@inkome.ai. For support or billing questions, email support@inkome.ai.
