Terms of Service

On This Page

These Terms of Service (“Terms”) govern your use of inkome.ai & the services provided through your inkome account (the “Service”). The Service is operated by INKOME LLC, a Delaware limited liability company (“inkome”, “we”, “us” or “our”).

By creating an account, purchasing a subscription or using the Service after these Terms have been made available to you, you agree to these Terms. If you use inkome for an organization or client, you represent that you have authority to act on their behalf. Our Privacy Policy explains how we handle personal information.

  • You Own What You Generate

Your products, text & images are yours. We take only the license we need to run the Service for you.

  • Review Before You Publish

Outputs are AI-generated & can be wrong. You are responsible for the accuracy, rights & legal compliance of what you sell.

  • We Take No Cut Of Your Sales

inkome charges no commission on the products you sell. Storefront & payment fees are charged by those providers, not by us.

  • Cancel Any Time

Cancel renewal from your billing settings. You keep your paid features & credits until the end of the period you paid for.

01

Eligibility & Your Account

You must be at least 18 years old, have reached the age of legal majority where you live & be able to enter into a binding contract. You represent that you meet these requirements. You may use inkome as an individual creator or on behalf of a business or client.

Keep your account information accurate & protect the Google or Discord account you use to sign in. You are responsible for activity you authorize through your account. Tell us promptly if you suspect unauthorized access. You must not share or resell account access outside any access arrangements we expressly offer.

You may use the Service only where doing so is lawful, including under applicable sanctions & export restrictions.

02

The Service

inkome helps you analyze channel content, develop product ideas, create & edit digital products, generate promotional materials, build branded stores, connect supported commerce services & understand product performance. Depending on the features available, channel analysis may include public videos, channel details & comments. Available features, limits & integrations depend on your plan & the Service as offered at the time.

Hosting & publishing provided through your inkome subscription may use the Publy Store brand or a publy.store address. These Terms govern those services as part of your relationship with inkome. They do not set the purchase terms between you & your buyers or govern separate services obtained independently from Publy Store.

The Service may evolve. Features described as coming soon are not included until released. Purchasing a subscription does not guarantee the release of any future feature or integration. We may limit, change or discontinue a source, integration or feature when required by law, a provider’s rules or operational needs.

03

Source Content & Channel Rights

The ability to enter a public channel URL does not give you ownership of that channel or permission to use its protected content, identity or branding. You may use the Service to explore public information, but every use of source material must have a lawful basis.

You represent that you hold the rights, permissions or other lawful basis needed for the material you submit, select, reproduce or use through the Service, including any processing you instruct us to perform. You must also have authority to grant the licenses in these Terms. Agencies are responsible for obtaining the necessary authority from their clients.

You must not falsely attribute a product to a creator, imply an endorsement or affiliation that does not exist, or use another person’s name, logo, likeness or protected work unlawfully. Review automatically suggested branding, author names & other identifying details before using them.

Our generation of an idea, product or store does not confirm that you have permission to use the source material. Public availability alone does not establish that permission.

04

Ownership & Permission To Operate The Service

You retain your rights in the material you provide. As between you & inkome, you own the products, text, images & other outputs generated for you through the Service, to the extent ownership rights exist. To the extent we acquire transferable rights in those outputs, we assign them to you.

This does not transfer rights in third-party material, inkome’s software, templates, underlying technology, trademarks or other platform materials. Those remain with their respective owners. You may use platform elements included in your exported products as needed to use & sell those products, subject to any applicable third-party license disclosed to you.

AI outputs may be similar to material generated for others & may not qualify for copyright protection. We do not guarantee exclusivity, originality, registrability or freedom from third-party claims.

You grant us a non-exclusive, worldwide, royalty-free license to access, reproduce, process, adapt, store & display your material & outputs as needed to provide, maintain, secure & support the Service & carry out your instructions. We may allow providers working for us to exercise these rights for those purposes. Personal information remains subject to our Privacy Policy.

Ending your subscription does not transfer ownership of your products to inkome or end your right to use & sell copies you have lawfully downloaded or exported. It does end access to services that require an active subscription.

05

Marketing Permission

Creator. You permit inkome to mention the name of a channel you own or are authorized to represent & use with a Creator subscription, solely to identify that channel as a user of inkome in our marketing. This permission covers channel names only. It does not authorize the use of channel logos, likenesses, products, promotional materials, store pages or other content in our marketing, or imply a personal endorsement.

This permission survives cancellation & an upgrade to Pro, but references must accurately describe whether a channel currently uses or previously used inkome.

Pro. We will obtain your permission before mentioning your channel’s name in our marketing, unless the reference is already permitted under a Creator subscription.

These permissions remain subject to applicable personal data rights, confidentiality obligations & rights belonging to someone else.

06

AI Content & Your Review

The Service uses AI. Outputs may contain invented facts, inaccurate statements, misleading images, omissions, bias or material that infringes someone else’s rights. Automated editing or quality checks do not replace your review.

You are responsible for checking the accuracy, quality, rights & legal compliance of products, illustrations, descriptions, promotional materials & other content you use or sell. This includes statements about real people or events, testimonials, product benefits, pricing & results.

You must include any AI disclosures, advertising disclosures, warnings or other information required by law or the platforms you use. You must not remove legally required provenance information or present generated material in a misleading way. These responsibilities do not remove obligations that applicable law places directly on inkome.

The Service does not provide professional medical, legal, financial or other regulated advice. Obtain qualified review where your product or its intended use requires it. Recommendations about products, pricing or promotion do not guarantee sales, income or other results.

07

Stores, Public Pages & Approved Actions

Generated stores & product pages are password protected while marked Draft. They become publicly accessible when you publish them. Anyone you give the draft password to may view the draft, so keep that password secure & share it only with people you authorize. Review the content, branding & settings before publishing.

You instruct us to carry out actions when you request generation, approve a change or use a publishing or integration control. You are responsible for reviewing the content, destination, price & settings associated with those actions. We require your instruction or approval for publication to a connected commerce service & for changes to your offers or prices.

You are responsible for the material available through your stores, the notices & policies your buyers need, & any domains you connect. Public pages may be copied or indexed by others. Removing a page from our hosting does not remove copies held elsewhere.

Unless expressly sold or registered to you separately, a publy.store address is a hosted address provided with the Service, not a domain you own. Hosting remains subject to your subscription, these Terms & any separately disclosed domain terms.

08

Selling Products & Your Buyers

You offer your products through the commerce accounts you connect. You receive sales proceeds through those providers. inkome charges no commission on your product sales. Storefront, payment, currency conversion & other third-party fees apply separately.

As between you & inkome, you are responsible for your product offers, buyer terms, delivery or access, customer support, refunds, chargebacks, invoices & sales taxes. Automated tools may assist you, but you remain responsible for checking that your sales process works & that buyers receive what you promise.

We do not act as the seller or merchant of record for your products or hold your sales proceeds. A connected provider may have its own role & responsibilities under its terms or applicable law. Nothing here reallocates obligations that law places on that provider or on inkome.

Buyer information. You are responsible for the privacy notices, permissions & lawful basis required for personal information you make available through the Service.

Where we handle that information solely on your behalf, you act as controller & inkome acts as processor. This includes collecting, storing, organizing, transmitting & deleting buyer names, contact details & order information to operate your store, support connected features & carry out your instructions during the applicable service period.

We process this information only under your documented instructions, including these Terms & the settings or actions you select, unless applicable law requires otherwise. We will notify you of any such legal requirement before processing unless prohibited, & promptly inform you if we believe an instruction violates applicable data-protection law. International transfers remain subject to your instructions & legally required safeguards.

We restrict access to authorized persons subject to confidentiality obligations & maintain technical & organizational measures appropriate to the risks. We will notify you without undue delay after becoming aware of a personal data breach affecting this information. Taking account of the processing & information available to us, we will assist with privacy requests, security obligations, breach reporting, impact assessments & required regulatory consultations, including by providing relevant records & incident information.

You generally authorize us to use service providers bound by equivalent written data-protection obligations. We remain responsible for their performance. Their identities, functions, processing locations & relevant security information will be made available to you privately before processing begins. We will notify you before adding or replacing a provider & give you a reasonable opportunity to object on data-protection grounds.

When the relevant processing services end, we will return or delete the information at your choice & delete remaining copies, except where continued retention is required by applicable law & consistent with applicable data-protection requirements. This obligation takes priority over general retention provisions where data-protection law requires it.

We will provide information necessary to demonstrate compliance, allow & assist with legally required audits or inspections, subject to reasonable confidentiality & security arrangements. Instructions, information requests & audit arrangements may be directed to data@inkome.ai.

09

Acceptable Use

You must not use the Service to:

  • Infringe intellectual property, privacy, publicity or other rights.
  • Impersonate someone, invent endorsements or reviews, defame a person, or deceive buyers.
  • Create or distribute unlawful content, sexual exploitation material, threats, unlawful hate content or instructions intended to facilitate violence or other serious harm.
  • Conduct fraud, send unlawful spam, distribute malware or misuse personal information.
  • Access accounts or systems without permission, bypass payment or usage limits, or interfere with the Service or other users.
  • Scrape, reverse-engineer or extract the Service’s software or underlying systems, except where applicable law expressly permits it.
  • Use automation to evade plan limits, abuse a feature described as unlimited, or resell access without our written permission.

An unlimited feature has no fixed total usage allowance for its advertised use. It remains subject to these Terms, service availability, reasonable rate limits & measures against abuse or excessive system load. Rate limits may restrict request frequency or the number of simultaneous requests.

10

Subscriptions & Renewals

Your plan’s price, billing interval, included channels, features & credit allowance are shown when you subscribe. Creator is offered per channel; Pro includes the channel allowance stated in its offer. Additional channels & plan changes are governed by the terms & charges disclosed when you select them.

Subscriptions renew automatically for the billing interval you select unless you cancel before renewal. Available billing intervals are shown at checkout. Annual billing & other options apply only when offered. You authorize our payment processor to charge the applicable subscription fees & taxes using your payment method.

We will disclose the effective date, charges & any credit adjustment for a plan change before you confirm it. We do not promise a particular upgrade, downgrade, channel replacement or proration arrangement unless it is offered to you.

If your subscription qualifies for a founding price, that price remains locked for the qualifying plan or channel offering until the subscription is marked cancelled in our billing system. Turning off automatic renewal or a failed payment does not by itself end the founding price unless the subscription is marked cancelled. The price lock does not fix taxes or the price of separate purchases. Once the subscription is marked cancelled, the founding price does not automatically return when you resubscribe.

We will give advance notice of other recurring price changes before they apply to a renewal, allowing you to cancel first. Such changes do not override an applicable founding-price commitment or change fees for a period already paid for.

11

Credits & Loyalty Allocations

Credits measure use of eligible features. Your credit balance is shared across the channels in your account. The applicable credit cost is shown before you start a chargeable action.

Monthly subscription credits are allocated for each monthly billing period. Unused credits expire at the end of that period & do not roll over unless you purchase an offer that expressly provides otherwise. A failed generation will not consume credits, or the corresponding credits will be restored. A completed output you dislike is not automatically a failed generation.

Where your plan includes loyalty increases, your allocation grows according to the schedule shown in your offer during paid access. Turning off renewal or a failed payment does not by itself reset loyalty. Loyalty resets once the subscription is marked cancelled in our billing system & does not carry over if you later resubscribe.

When annual subscriptions are offered, the annual credit allocation is the plan’s highest monthly loyalty allocation multiplied by 12, credited at the start of the paid year. That pool is available throughout the paid year & expires at its end. It is not replaced by a monthly allocation.

If we offer extra credit purchases or rollover options, their price, eligibility, duration & expiry rules will be disclosed with the offer. Credits require an active subscription unless expressly stated otherwise. Credits are not money, cannot be transferred or resold & have no cash redemption value except where law requires otherwise.

12

Payments, Refunds & Disputes

Subscription payments are handled by Stripe. Keep your billing information current & ensure your payment method can be charged. Fees may be subject to taxes identified at checkout.

No refund policy. inkome operates a strict no-refund policy. By purchasing a subscription, credits or other paid services, you acknowledge & agree that all sales are final, except where a refund is required by applicable law.

Subscription fees pay for access to inkome’s digital tools, generation features & hosted services during the applicable paid period. We do not offer refunds for unused subscription time, unused credits, partial use, changes of mind or dissatisfaction with a completed AI-generated output. Canceling stops future renewals & does not refund the current paid period. Failed generations remain subject to the credit restoration policy in Credits & Loyalty Allocations.

This policy does not limit consumer rights, applicable withdrawal rights or remedies that cannot lawfully be excluded.

Billing questions & disputes. For billing questions or disputes, contact support@inkome.ai.

We may restrict paid access associated with a reversed or unpaid charge while the matter is investigated, to the extent permitted by law. Fraudulent or abusive disputes & material nonpayment may result in suspension or termination. We will correct restrictions or credit deductions caused by a confirmed billing error.

Nothing in this section limits your lawful payment dispute rights or requires you to contact us before exercising a right that applicable law protects.

13

Cancellation & What Happens Afterward

You may cancel renewal from your billing settings at any time. Unless access is lawfully suspended or terminated earlier, you retain your paid features & remaining credits until the end of the period you have paid for.

When paid access ends, generation, inkome-hosted stores, tracking links, analytics & other subscription-dependent services stop. Unused credits expire subject to any mandatory rights or different terms expressly included in your offer.

You remain entitled to use & sell products you have lawfully downloaded or exported. Cancellation does not by itself remove listings or files from your independent commerce accounts, reverse completed purchases or cancel licenses already granted to your buyers. You must arrange any continuing delivery, hosting or support those buyers need.

Unless you renew or request earlier deletion, we delete project data from active account storage 90 days after paid access ends. Download or export anything you need before access ends; the retention period does not provide continued paid access. Accounting records, legal holds, backups & marketing copies are handled as described in our Privacy Policy.

Deleting your account is separate from turning off renewal. When we receive a verified account-deletion request, we stop future subscription renewals as part of processing that request. Account deletion does not itself refund charges already paid or waive amounts lawfully owed. You can request account deletion or access to your personal information at data@inkome.ai.

14

Third-Party Services

The Service relies on external providers & may connect with third-party services, including, but not limited to, Google, Discord, YouTube, Stripe, Whop, Gumroad & Shopify. Your use of those services is subject to their applicable terms & privacy policies.

By using the Service’s YouTube-related features, you also agree to be bound by the YouTube Terms of Service.

You authorize us to exchange information with a connected service & perform the actions you instruct through the integration. You are responsible for meeting that service’s eligibility requirements & maintaining your account with it. You can disconnect supported commerce integrations through your account.

Integrations may change, become unavailable or impose additional limits. We may limit or suspend an integration when required by a provider, applicable law or operational needs. We do not control third-party decisions or guarantee their continued availability. This does not exclude responsibility that applicable law places on us for the Service we supply.

15

Privacy & Service Access

Our Privacy Policy describes the information we process, including account information, public source content, generated material, technical information & information received from connected stores.

Authorized personnel & service providers may access information as needed to operate, support, secure or maintain the Service, investigate abuse or meet legal obligations. Pro’s permission requirement for channel-name references in our marketing does not prevent this operational access.

16

Suspension & Termination

We may restrict content or suspend or terminate access where reasonably necessary because of a material breach, fraud, nonpayment, unlawful activity, a security threat or a binding legal requirement. We may also remove content in response to a substantiated rights complaint or restrict repeat infringers.

Where reasonable & lawful, we will explain the reason & give you an opportunity to address a remediable problem. We may act immediately where delay could cause harm, compromise security or conflict with legal obligations.

On lawful termination for breach, access ends & remaining credits may be forfeited to the extent permitted by law. Any fees already owed remain payable. If we discontinue your paid Service for reasons unrelated to your breach, we will provide reasonable notice. Any refunds or other remedies required by applicable law remain available.

Ownership, licenses intended to survive, accrued payment obligations, liability provisions & other provisions that by their nature should continue remain effective after termination.

17

Feedback

If you provide suggestions or feedback, you grant us a perpetual, worldwide, royalty-free right to use & adapt it to develop & improve our products without payment or attribution. This does not give us ownership of your products or override a separate confidentiality agreement or your personal data rights.

18

Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” & “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose & non-infringement. We do not warrant that outputs will meet your requirements or that the Service will always be accurate, uninterrupted or error-free.

You are responsible for keeping independent copies of products & other material you need. Availability can be affected by maintenance, technical problems, third-party failures & circumstances beyond our reasonable control.

These disclaimers do not remove express commitments included in your purchased plan, including any applicable support response commitment, or protections that cannot lawfully be excluded. A response-time commitment concerns an initial response, unless the offer expressly promises a resolution time.

19

Limitation Of Liability

To the fullest extent permitted by law, inkome & its officers, employees, contractors & service providers will not be liable under these Terms for indirect, incidental, special, consequential or punitive losses, including lost profits, revenue, goodwill or business opportunities.

To that same extent, our aggregate liability arising from or relating to the Service or these Terms will not exceed the fees you paid to inkome for the Service in the 12 months before the event giving rise to the claim. This limit applies regardless of the legal basis of the claim.

Nothing in these Terms excludes or limits liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or any other liability or statutory remedy that cannot lawfully be excluded or limited. Where you are a consumer, mandatory protections in your jurisdiction take priority.

20

Claims Arising From Your Business Use

If you use the Service for a business or professional purpose, you agree, to the extent permitted by law, to defend & indemnify inkome & its officers, employees & contractors against third-party claims, damages & reasonable legal costs to the extent caused by your unlawful content, infringement of another person’s rights, breach of these Terms or dealings with your buyers.

This obligation does not apply to the extent a claim is caused by our own breach, negligence or unlawful conduct. We will notify you promptly of a claim, provide reasonable cooperation & allow you to control the defense with competent counsel. You may not agree to a settlement that admits fault by us, imposes obligations on us or fails to release us without our written consent, which will not be unreasonably withheld.

21

Governing Law & Disputes

These Terms are governed by Delaware law, excluding its conflict-of-law rules. Subject to mandatory rights, disputes will be brought in the state or federal courts located in Delaware, & each party submits to those courts.

If you are a consumer, these provisions do not deprive you of mandatory protections under the law of your habitual residence or prevent you from bringing a claim in another court where applicable law gives you that right.

22

Changes & General Terms

We may update these Terms as the Service or applicable requirements change. We will give reasonable advance notice of material changes through the Service or by email, stating when they take effect. More immediate changes may be necessary for legal or security reasons. Where the law requires your express agreement, we will obtain it.

Changes do not apply retroactively to resolved transactions or expand previously granted marketing permissions without any agreement required by law. If you disagree with a change, you may cancel renewal & stop using the affected Service. Continued use after notified changes take effect constitutes acceptance to the extent permitted by law.

These Terms, the applicable plan or checkout terms & any separate agreement with us form the agreement governing your use of the Service. Specific commitments in your offer prevail over conflicting general wording here. If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver.

You may not transfer your account or these Terms without our consent. We may transfer our rights & obligations as part of a merger, acquisition or business transfer, provided this does not reduce your mandatory rights. These Terms do not create a partnership or employment relationship.

23

Contact & Rights Complaints

For questions, billing concerns or complaints about content hosted through inkome, email support@inkome.ai. For privacy, access or deletion requests, email data@inkome.ai.

For a rights complaint, identify the work or right concerned, the specific content & its location, your contact details, & why you believe the use is unauthorized. Include any statements, signature or other information required by the applicable notice procedure. We may request information needed to assess & respond to the complaint.
